The following policy sets out Mindworx’ policy regarding the collection, storage and use of personal information.

Protecting your Privacy is Important to us
In accordance with the National Privacy Principles as outlined in the Privacy Amendment (Private Sector) Act 2001, Mindworx is committed to ensuring the privacy of personal information of all individuals and organisations from which or about which it receives information on, including visitors to our website.

Collection of your Personal Information
Mindworx collects information relevant to our recruitment services and in compliance with legislative obligations. As part of our operations, it is necessary for us to collect personal information relevant to any one or more of the following purposes:

>  client and business relationship management
>  marketing

In some circumstances Mindworx may also collect sensitive information about the individual such as their membership in a professional or trade association or trade union; their health (including disability), their racial or ethnic origin or any criminal record that they may have. In any case, we will obtain consent, prior to collecting such information.

Where possible, Mindworx collects personal information directly from the individual or organisation via face to face meeting, telephone conversation, letter, fax, email or our website.

For individuals, personal and sensitive information may also be collected via third party for reasons such as:

>  competency or medical tests
>  information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which the individual or organisation is involved with

In all instances we will endeavour to gain your prior consent, however where not practicable, we will take all reasonable steps to inform you that this has occurred.

Use and Disclosure of your Personal Information
Mindworx is committed to offering a safe and secure service to all individuals and organisations it deals with, and thus are committed to ensuring that any information provided to us remains private unless used and disclosed for the purposes for which it is primarily held and in some cases for related secondary purposes.

If Mindworx wishes to use or disclose any personal information in other circumstances we will obtain consent prior to doing so, other than in exceptional circumstances such as:
>  where Mindworx reasonably believes it is necessary to lessen or prevent a serious and imminent threat
    to any individual's life, health or safety, to public health and safety, and/or Mindworx’ rights or property;
>  the use or disclosure is authorised or required by law or is reasonably necessary to enforce or comply with the law

If we engage third party contractors to perform services for us, which involves handling personal information, Mindworx will take all reasonable steps to prohibit the contractor from using any personal information except for the purposes for which it is primarily held.

Quality and Accuracy of your Personal Information
Mindworx is committed to taking reasonable steps to ensure our records are kept accurate and up-to-date. To do so, we may contact the individual or organisation from time to time to check that the information is accurate.

In the event of any changes to personal information please contact us and we will endeavour to update and correct the information.

Security of your Personal Information
Mindworx will take all reasonable steps to protect personal information and to safeguard personal information from misuse, loss, modification and disclosure.

All personal information is held on secure servers and/or cabinets of which is only accessible to authorised personnel. In addition the office is locked at all times in the absence of its employees.

Retention and Destruction of your Personal Information
Mindworx only keeps personal information on file as long as it is necessary to fulfill business needs and legislative requirements. Any personal information, which is no longer required, will be destroyed or disposed of in a secure manner. Hard copy information will be shredded and thrown out in a secured disposal bin, while electronic records will be deleted from both the computer hardware and the network.

Gaining access to your Personal Information
Mindworx welcomes the request of any personal information that Mindworx holds about the individual or organisation. A copy of the information can be obtained by written request. This written request should be sent to:

When considering the request, Mindworx will take all necessary steps to confirm the requesting party’s identity prior to sending any personal information. Once confirmed, a copy of the party’s file will be made available within 30 days. Any costs associated to finding the information will be stated prior to performing the task.

Complaints will be handled impartially and as promptly as possible. Only those parties who are involved in the investigation of the complaint will have access to personal information in relation to the complaint. However when considering any inquiry or complaint, Mindworx will take all necessary steps to confirm your identity prior to acting on your request.
